1. Agreement

These Terms of Service ("Terms") govern your use of KumoTools and KumoMoments (together, the "Service"), operated by KumoTools ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Who can use the Service

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the Service. If you use it on behalf of an organisation you confirm that you have authority to bind that organisation to these Terms.

3. Your content and rights to the source material

You are solely responsible for the videos, Twitch and YouTube VODs, links, audio, images, and other material ("Your Content") you submit, upload, or ask us to analyze.

You must own Your Content or have all necessary rights, licences, and permissions to download, transcribe, analyze, and republish it. This includes making sure any co-streamers, guests, music, clips, or third-party material inside a VOD are cleared for the way you plan to use the output.

You retain ownership of Your Content. We do not claim any ownership over it. You grant us a limited, worldwide, royalty-free licence to store, process, transcribe, and analyze Your Content only for the purpose of providing the Service to you.

4. AI outputs are suggestions, not facts

KumoMoments uses automated speech-to-text and large language models to suggest clips, titles, descriptions, hashtags, and timestamps. These outputs can be inaccurate, incomplete, biased, or offensive. You are responsible for reviewing every AI-generated suggestion before publishing it. We make no warranty that any output is accurate, safe to publish, or fit for any particular purpose.

5. Acceptable use

You agree not to use the Service to:

submit content you do not have the right to process, or that infringes anyone's intellectual property, privacy, or publicity rights;
submit content that is illegal, sexual content involving minors, harassing, defamatory, or otherwise harmful;
attempt to reverse-engineer, resell, scrape, or overwhelm the Service; or
bypass authentication, payment, or rate limits.

6. Payments and refunds

KumoMoments is pay-per-analysis. Payments are processed by Stripe. We never see or store your full card details. Prices are shown in US dollars before you check out.

Because each analysis triggers real transcription, media, and AI compute costs the moment you start it, completed analyses are non-refundable. If an analysis fails on our side and produces no usable output we will re-run it or refund the transaction. Contact us within 14 days.

Introductory free VODs are one-time per person, not per account. New accounts receive a promotional allowance of subsidised VODs (the first few hours of each). This allowance is tracked against your email address in hashed form so that deleting your account and creating a new one with the same email does not reset the promotion. Attempting to farm the allowance through multiple accounts, aliases, or throwaway inboxes is a breach of these Terms and we may refuse service, revoke unused credits, or require payment for analyses run under those accounts.

7. Storage and account limits

Uploaded source video and the audio we prepare from it are automatically deleted from our object storage after 7 days by a storage lifecycle rule, regardless of whether you delete the project.

Transcripts, clip suggestions, and other project data stay in your account until you delete them, up to a per-user cap displayed in the Service. When you approach the cap we will warn you and let you choose what to remove. You can export a copy of your data or delete your account at any time from your Account page.

8. Service availability

We try hard to keep the Service running, but we provide it "as is" and "as available". We may change, suspend, or discontinue features at any time and we do not guarantee uptime, absence of bugs, or that the Service will always meet your needs.

9. Account termination

You can delete your account and Your Content at any time. We may suspend or terminate your access if you breach these Terms, abuse the Service, or create legal or safety risk for us or other users. Where reasonable we will notify you first.

10. Limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind and we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or any loss of profits, revenues, data, goodwill, or content. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of USD 50 or the amount you paid us in the 3 months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or damages, including reasonable legal fees, made by any third party arising out of Your Content, your use of the Service, or your breach of these Terms, including claims that you did not have the rights to the media you submitted.

12. Changes to these Terms

We may update these Terms from time to time. When we do we will update the "Last updated" date at the top. Continued use of the Service after changes means you accept the updated Terms.
